Terms of Service
By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Onroad Driving Education - ABN 57 134 647 126.
Onroad Driving Education reserves the right to update and change the Terms of Service without notice.
By booking a lesson or course with Onroad Driving Education, you confirm that:
- You hold a valid Australian learner licence, driver licence or an overseas licence that legally permits you to drive in Australia.
- You will carry your licence during every lesson.
- If you are under 18 years of age, a parent or legal guardian has authorised your booking and agrees to these Terms and Conditions on your behalf.
- You are medically fit to drive and will advise your instructor of any medical condition, injury or medication that may affect your ability to drive safely.
- All lessons must be paid in advance to secure a booking.
- Payment is required at the time of booking or within 24 hours of reserving a lesson time.
- Bookings are not confirmed or held without payment.
- High-demand times (e.g. after school and weekends) should be booked early to avoid disappointment.
- Lesson credits refer to prepaid lessons purchased through packages or gift certificates.
- These credits will be automatically applied when booking lessons.
- If you rebook a lesson, payment (or use of lesson credit) must be completed within 24 hours.
- If you are unsure of your availability, you should not make a booking until confirmed.
- Onroad does not hold tentative bookings without confirmation and payment.
- Students will receive confirmation of lesson date and time via message.
- It is the student’s responsibility to ensure they attend the scheduled lesson.
- Failure to attend a lesson will be treated as a non-attendance and charged accordingly.
Students are responsible for:
- Arriving on time and ready to commence the lesson.
- Wearing suitable footwear. Bare feet, high heels, thongs or footwear that may affect safe operation of the vehicle are not permitted.
- Wearing prescription glasses or contact lenses where required by their licence.
- Following all lawful instructions given by the instructor.
- Treating instructors, staff, vehicles and equipment with respect at all times.
Lessons may be terminated immediately where a student:
- Acts aggressively or abusively.
- Is suspected of being under the influence of alcohol or drugs.
- Refuses to follow the instructor's directions.
- Creates an unsafe situation for themselves or others.
Where a lesson is terminated for these reasons, the full lesson fee will apply.
Cancellations & Rescheduling
- A minimum of 1 full business day’s notice is required to cancel or reschedule a lesson.
- Cancellations made within this period will incur a full lesson fee.
- A minimum of 3 business days’ notice is required.
- Late cancellations will incur the full driving test booking fee, as time cannot be reallocated.
- Failure to attend a scheduled lesson will be treated as a cancellation and charged in full.
- If Onroad is able to fill your cancelled time slot, the cancellation fee may be waived at our discretion.
Instructor Availability & Rescheduling
While we aim to deliver all lessons as scheduled:
- Lessons may occasionally be rescheduled due to:
- Instructor illness
- Mechanical issues
- Unforeseen circumstances
- Where possible:
- You will be given notice
- An alternative time or instructor will be arranged
- Instructors may occasionally run up to 15 minutes early or late, and students should be prepared and check messages accordingly.
While we will make every effort to provide your preferred instructor and vehicle, we cannot guarantee instructor or vehicle availability.
Instructor Vehicle Use (Driving Tests)
When using an instructor vehicle for a driving test, the learner accepts full responsibility for:
- Damage caused to the vehicle where the learner is at fault
- Damage where the responsible party cannot be identified
- Any fines incurred during the test
- Theft or loss of the vehicle
The learner agrees to cover costs including:
- Repairs
- Towing
- Insurance excess (up to $1400)
- Any third-party damage
Payment must be made within 14 days where applicable.
The instructor reserves the right to decline to present a learner for a driving test if, in their professional opinion, the learner has not yet demonstrated the competency required to safely undertake the test.
Traffic Offences, Fines & Demerit Points
The student acknowledges that they are the driver of the vehicle during all driving lessons and are responsible for complying with all applicable road rules.
Any traffic infringements, fines, penalties, toll notices or demerit points incurred as a result of the student's driving during a lesson will remain the responsibility of the student, except where the law provides otherwise.
Onroad Driving Education and its instructors accept no liability for traffic infringements, fines, demerit points or other penalties resulting from the student's actions while operating the vehicle.
If students use their own vehicle
Where lessons are conducted in the student's own vehicle, the student is responsible for ensuring the vehicle is registered, roadworthy and appropriately insured. The student remains responsible for any infringements, tolls or demerit points incurred during the lesson.
If students use an Onroad vehicle
Where a traffic infringement notice is issued to the registered owner of an Onroad Driving Education vehicle, the details of the student driver may be provided to the relevant authority where permitted by law so that liability for the offence can be determined.
Safer Drivers Course Policy
- 7 days’ notice: Full refund
- Up to 48 hours’ notice: No refund, but rescheduling permitted
- Less than 48 hours’ notice: Full fee applies
- Non-attendance: No refund
If the course is cancelled by Onroad:
- You will be rescheduled or offered a refund
Late arrivals may not be permitted to attend.
Please note: The time and venue selected when booking the Safer Drivers Course are for Module 1 only. We will contact your before the course to schedule a time for Module 2. If we need to make any changes to the venue or time (due to TfNSW requirements), we will be in touch with you well in advance.
Communication & Responsibility
- Students are responsible for:
- Monitoring messages regarding bookings
- Ensuring they attend scheduled lessons
- Onroad provides clear communication for all bookings, and failure to attend due to oversight will not be accepted as a valid reason for non-attendance.
- Onroad Driving Education reserves the right to:
- Refuse service
- Reschedule lessons where necessary
- Modify services, pricing, or availability
- All services are subject to availability.
By booking services, you acknowledge that your information may be shared with relevant authorities (e.g. TfNSW) where required for course verification and compliance purposes and may be used by such authorities in certain cases, such as verification of completion of the Safer Drivers Course.
Onroad Driving Education will not be held liable for:
- Delays or cancellations outside of our control
- Incidents occurring where the learner is responsible
- Driving test outcomes
- Mechanical breakdowns
- Road closures
- Severe weather
- Government restrictions
- Third-party actions
Onroad Driving Education will not be liable for delays, cancellations or interruptions caused by events beyond our reasonable control, including natural disasters, severe weather, road closures, pandemics, industrial action, government directives or vehicle breakdowns.
Lessons generally proceed in wet weather. Lessons will only be cancelled where weather conditions are considered unsafe by the instructor. Where Onroad cancels due to severe weather, your lesson will be rescheduled at no additional cost.
Lesson packages and prepaid credits remain valid for 12 months from the date of purchase. Requests for expiry extensions due to illness, injury or exceptional circumstances must be submitted in writing before the expiry date and will be considered at Onroad's discretion.
Gift vouchers are non-refundable and cannot be redeemed for cash. Unless otherwise stated, vouchers are valid for 12 months from the date of purchase.
Discounts, promotional offers and complimentary lessons cannot be combined unless expressly stated and are not redeemable for cash.
All course materials, online courses, webinars, manuals and digital resources remain the intellectual property of Onroad Driving Education and may not be copied, reproduced, distributed or shared without written permission.
ELECTRONIC COMMUNICATIONS
By booking with Onroad Driving Education, you consent to receive lesson confirmations, reminders, booking updates and other service-related communications via SMS, email and telephone. You may opt out of marketing communications at any time.
DIGITAL PRODUCTS, ONLINE COURSES & WEBINARS
- Digital products, including online courses, webinars, downloadable resources and other digital content, are non-refundable once access has been granted or the content has been viewed, downloaded or accessed.
- If a technical issue prevents access to purchased digital content, Onroad Driving Education will make reasonable efforts to resolve the issue or provide alternative access where appropriate.
- Course access is provided solely to the purchaser and must not be shared, copied, reproduced, distributed or made available to any other person without the prior written consent of Onroad Driving Education.
- No refunds will be issued after access has been granted for any digital product.
- Onroad Driving Education reserves the right to suspend or terminate access to digital products where unauthorised sharing or misuse is suspected.
PHOTOGRAPHY & VIDEO CONSENT
From time to time, Onroad Driving Education may take photographs or video recordings during driving lessons, courses, webinars or other training activities for promotional, educational or marketing purposes.
- Where a student is identifiable in any marketing material, Onroad Driving Education will obtain the student's permission before publishing the content.
- If you do not wish to appear in any photographs or videos, please notify your instructor or contact our office at any time. Your preference will be respected and will not affect your participation in any lesson, course or service.
Onroad Driving Education will never sell or disclose photographs or video recordings to third parties for commercial purposes without your consent, except where required by law.
Account Terms
This page contains the most current version of the Terms of Service.
- You agree that Onroad Driving Education can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
- You are responsible for maintaining the security of your account and password. Onroad Driving Education cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- By purchasing from Onroad Driving Education, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with Onroad Driving Education.
- You must not post or submit false information to the Service.
- You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
- You are responsible for all activity that occurs from your account.
- Accounts registered by "bots" or other automated methods are not permitted and will be removed.
- Onroad Driving Education has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Onroad Driving Education service, for any reason.
- Violation of any of the terms or general conditions may result in the termination of your Account.
- In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Onroad Driving Education has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Onroad Driving Education service. Such termination of the Service will result in the deactivation of your Account.
Cancellation Rates
- Less than 24 hours notice before the booking will forfeit the full booking fee.
A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Onroad Driving Education.
Refund Policy
All refunds must be resolved directly with Onroad Driving Education.
Modifications to Services and Prices
- Onroad Driving Education reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
- Prices of all Services are subject to change with or without notice.
- Onroad Driving Education shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Vouchers
- Vouchers are non-refundable and cannot be redeemed for cash.
- Unused vouchers can be transferred between clients.
- Vouchers are valid for 12 months from the date of purchase.
Fees
- Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Onroad Driving Education for payment processing.
- All fees and transactions are in Australian Dollars.
General Conditions
- Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Onroad Driving Education.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Onroad Driving Education customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
- You must not transmit any worms or viruses or any code of a destructive nature.
- You understand that Onroad Driving Education uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
- Onroad Driving Education does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
- You expressly understand and agree that Onroad Driving Education shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Onroad Driving Education has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
- The failure of Onroad Driving Education to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
- You expressly understand and agree that Onroad Driving Education shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
