Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Onroad Driving Education - ABN 57 134 647 126.

Rebooking

• All lessons are to be paid in advance so if you rebook another lesson then payment is due at the time of rebooking or within 24 hours of us taking the booking to reserve your day and time for your next lesson. 
• Lesson credits are lessons already purchased by way of packaged lessons or gift certificates. 
• If you have a lesson credit from your package lessons then this will be deducted and cancellation fees will then apply for any cancellations or rescheduling with less than 1 business days' notice given. 
• If you are not sure if you can keep your booking then best you don’t make it until you are sure, we can’t assume you might be available to do a lesson, we work on the basis you are or you aren’t.
• We may not be able to reserve a particular day and time as this may have been already reserved for someone else if they are not booked early.
• We do not reserve lesson spaces without payment being made so bookings should be made early especially for after-school lessons or weekends.
• All students are sent a message with their lesson information on what day and time it is. At the end of a lesson the student will be asked do they want to rebook and if so then the date and time will be messaged to the students so you should add our phone numbers to your contact list, there are no reasons to say you “forgot” we don’t forget so neither should you.

Non-Attendance

• If a lesson is cancelled by the participant for any reason within 24 hours of the start time of the lesson, the participant will be charged a full cancellation fee, which is the cost of the lesson.

• Non attendance of a lesson will be treated as a cancellation.

Cancellations

• Cancellation fees charged are equal to the amount of the lesson value as singles or part of a lesson package already purchased which includes driving tests.
  
• 1 Full Business Days Notice Required. We operate 7 days and most public holidays. Our time is worth money and we do charge for a late cancellation and for non-attendance. The fee is equal to the time that has been booked for the amount we would have been paid.
• A full lesson fee is charged for any lessons cancelled with less than 1 business days notice as we are usually unable to fill the booking space we have reserved for you at short notice.
  
• A driving test fee is charged for any driving test cancelled with less than 3 business days notice as we are unable to fill the booking space we have reserved for you. We book out 3 hours of time for a driving test and cannot fill that space at short notice.
  
• We may from time to time be able to move a lesson time on the day to earlier or later subject to availability of spaces.
• Full payment for a new booking will then be due before we can take your booking and reserve another time and day.
  
• In the event, we do fill your space at short notice you will not be charged or have a lesson deducted.
• You will also be notified of this.
• From time to time we may also need to reschedule a lesson by giving a student or customer more than 48 hours’ notice or a lesson may be done by another instructor when required if your regular instructor cannot attend.
• Our instructors work 7 days and it’s inevitable at some stage with all the contact with students they may become sick and if they are very sick they may need to cancel a lesson on the lesson day or the night before, this wouldn’t include headaches or minor illness that can be worked through as they don’t like having to cancel or reschedule a lesson but safety comes first.
• There can be mechanical problems with cars from time to time, which may also mean a lesson is rescheduled. This is beyond our control.
• If this happens then the lesson will be rescheduled or if possible another instructor may be able to do the lesson. This rarely happens.
• The instructors will message a student if running late, please ensure you are ready when the instructor arrives.
  
• Instructors may run up to 15 minutes late or be early on some occasions students should check their phones for any messages.
  
  

TERMS OF USE with regard to INSTRUCTOR VEHICLE FOR DRIVING TEST:

Upon requesting the rental of an Instructor vehicle for the purposes of participating in the driving test, the Learner takes full responsibility for:

1. all damage to the vehicle if Learner is "at fault" or cannot identify nor have details of the person "at fault".

1. damage that is caused by the vehicle that is within Learner’s control.
2. theft or loss of the vehicle.
3. all fines accumulated during the driving test, regardless of when they are issued by the relevant authority.

Additionally, the Learner states that in such an event the Learner agrees to pay for the costs of repairs to the vehicle &/or property collided with, subject to the renter of two agreed quotes including...

1. actual cost of repairs
2. any towing fees
3. any excesses ($1400)
4. any fines

In the case of a disastrous incident, where the cost to repair is greater than the excess fees, the Learner will pay within 14 days.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Onroad Driving Education can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Onroad Driving Education cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Onroad Driving Education has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Onroad Driving Education service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Onroad Driving Education has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Onroad Driving Education service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Onroad Driving Education.

 

Modifications to Services and Prices

• Onroad Driving Education reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Onroad Driving Education shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers can be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Onroad Driving Education for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Onroad Driving Education.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Onroad Driving Education customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Onroad Driving Education uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Onroad Driving Education does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Onroad Driving Education shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Onroad Driving Education has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Onroad Driving Education to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Onroad Driving Education shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
